Terms of Service

Purestay is a curated collection and discovery platform for wellness-focused vacation rental homes. We help travelers find homes whose hosts have committed to specific standards, and we help hosts reach travelers who care about those standards.

Purestay is not:

• an owner, operator, manager, or agent of any home listed on the platform;
• a party to any rental, booking, or stay arrangement between a guest and a host;
• a travel agency, tour operator, insurer, or property manager;
• a guarantor of any home, host, guest, listing, or stay.

Every home on Purestay is owned or controlled by an independent third-party host. The contract for any stay is between the guest and the host, not with Purestay.

You must be at least 18 years old and able to form a binding contract to use Purestay. By using Purestay you represent that you meet these requirements.

Some features require an account. You are responsible for the accuracy of your account information, for maintaining the confidentiality of your credentials, and for all activity under your account. Notify us promptly at support@purestay.co of any unauthorized use.

Guests are required to create an account to book on commission-tier listings. An account is required on subscription-tier listings, you create an account and accept the Health & Environmental Disclaimer before we direct you to the booking destination the host designates.

Purestay operates two arrangements with hosts. Which one applies to a given host is determined by Purestay based on where the host is located and whether Stripe Connect supports direct-charge payouts for that country, not selected by the host:

(a) Commission. Available to hosts based in a country where Stripe Connect supports direct-charge payouts. Guests book and pay through the host's Purestay listing. Payment is processed by Stripe as a direct charge on the host's own connected Stripe account. The host is the merchant of record. Purestay collects a commission as an application fee at the time of the charge, at the rate assigned to that host under Section 3 of the Host Agreement. Purestay does not hold, control, or disburse guest funds, and does not issue receipts or refunds.

(b) Founding Host Membership (subscription). Assigned to hosts based in a country where commission is not yet available. Purestay lists the property and directs interested travelers to the booking destination the host designates, the host's own website, a third-party platform, or elsewhere. Purestay does not process the booking, does not handle payment, and takes no commission on subscription-tier stays. Purestay's role ends when the traveler leaves our platform.

The arrangement applicable to a given host is determined at onboarding and is reflected in how that host's listings behave at the point of booking. It is not selected by the host and does not vary by listing for a single host.

Using Purestay may require you to accept additional agreements:

• All users: these Terms and the Privacy Policy.
• Guests booking a commission-tier stay: the Guest Terms, the Health & Environmental Disclaimer, and the host's Rental Agreement.
• Guests leaving Purestay for a subscription-tier booking destination: the Health & Environmental Disclaimer, accepted at account creation before we direct you there.
• Hosts: the Host Agreement.

Each acceptance is recorded separately, including document identifier, version, timestamp, the identifying information of the accepting party, and IP address. Where a guest accepts a host's Rental Agreement, the applicable host is recorded as well.

Purestay's agreements and the host's Rental Agreement are separate agreements with separate parties and are never merged into a single acceptance.

Homes listed on Purestay are required to meet Our Standards, four conditions the host warrants and must keep current:

1. Fragrance-free. No undisclosed synthetic fragrance in cleaning products, provided toiletries, laundry products, or the home itself. Essential oils and other natural fragrance sources are permitted only where disclosed on the listing.
2. Natural-fiber bedding and towels: cotton, linen, silk, or wool.
3. Low-tox kitchen: stainless steel or cast iron cookware; glass or stainless cups and bowls; glass, stainless, or wood cutting boards; stainless or wood utensils.
4. At least one air purifier available in the home.

These standards are commitments by the host about products and practices. They are not guarantees of any environmental condition, and they are not promises about how any individual will experience a home.

Purestay reviews listings for alignment with Our Standards and suspends or removes homes that fall short. Purestay does not independently inspect or test any home, and does not guarantee any home. Standards information is supplied and warranted by the host.

Please read the Health & Environmental Disclaimer, which forms part of these Terms, before booking, particularly if you or anyone in your party has heightened sensitivity to fragrance, materials, or indoor environments.

You agree not to:

• use Purestay for any unlawful purpose or in violation of these Terms;
• misrepresent yourself, your property, or your affiliation;
• post false, misleading, infringing, defamatory, or harmful content;
• circumvent, disable, or interfere with security or access controls, including any password gate or tokenized link;
• scrape, crawl, harvest, or use automated means to access Purestay or extract data without our written permission;
• use Purestay to develop a competing product or service;
• interfere with the operation of the platform or with other users' use of it.

Your content. You retain ownership of content you submit, including listing text and photographs. You grant Purestay a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting and display), publish, and display that content for the purpose of operating, marketing, and promoting Purestay and your listing. This license continues for content that remains on the platform and for reasonable archival and promotional use of material already published.

You represent that you own or have the necessary rights to the content you submit and that it does not infringe any third party's rights.

Our content. The Purestay name, logo, design, and all platform content are owned by Purestay or its licensors and are protected by intellectual property laws. Nothing in these Terms grants you a right to use them.

Fees applicable to hosts are set out in the Host Agreement. Purestay does not charge guests a platform fee. The total shown to a guest at checkout on a commission-tier listing is payable to the host, who is the merchant of record.

Purestay may suspend or terminate your access, or suspend or remove any listing, at any time, with or without notice, including where we believe there has been a violation of these Terms, a failure to meet Our Standards, a risk to guests or hosts, or a legal or regulatory requirement.

Temporary suspension of a listing pending evaluation is a precautionary measure and not a finding of violation. Suspension or removal is a contractual remedy available to Purestay and is not a breach by Purestay, and creates no claim for lost bookings or revenue.

You may stop using Purestay at any time. Host cancellation terms are in the Host Agreement.

PURESTAY IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

PURESTAY MAKES NO WARRANTY REGARDING ANY HOME, HOST, GUEST, LISTING, OR STAY, INCLUDING THE CONDITION, SAFETY, LEGALITY, SUITABILITY, CLEANLINESS, OR ENVIRONMENTAL CHARACTERISTICS OF ANY HOME.

Information about homes, including Our Standards information, is provided and warranted by hosts, not by Purestay.

We do not warrant that the platform will be uninterrupted, secure, or error-free.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PURESTAY AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF PURESTAY OR ANY STAY, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO PURESTAY OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU PAID DIRECTLY TO PURESTAY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; (B) IF YOU ARE A GUEST, THE TOTAL AMOUNT YOU PAID FOR THE STAY GIVING RISE TO THE CLAIM; OR (C) TWO HUNDRED FIFTY U.S. DOLLARS ($250).

PURESTAY IS NOT LIABLE FOR THE ACTS OR OMISSIONS OF ANY HOST OR GUEST, OR FOR ANY INJURY, ILLNESS, REACTION, PROPERTY DAMAGE, OR LOSS ARISING FROM OR RELATING TO ANY HOME OR STAY.

Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the greatest extent permitted.

You agree to indemnify, defend, and hold harmless Purestay and its members, managers, officers, employees, and agents from any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of or relating to: your use of Purestay; your content; your violation of these Terms or any applicable law; your listing or your property (if a host); your stay or conduct (if a guest); or any dispute between you and another user.

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles.

Informal resolution first. Before starting any formal proceeding, you agree to contact us at support@purestay.co and attempt in good faith to resolve the dispute for at least thirty (30) days.

Binding arbitration. Any dispute not resolved informally will be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Idaho or conducted remotely. Judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. You and Purestay agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding.

Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property or prevent unauthorized access.

We may update these Terms. Material changes will be communicated by posting the updated Terms with a new "Last updated" date and, where appropriate, by email or in-product notice. Continued use after the effective date constitutes acceptance. The version in effect at the time of your acceptance governs the transactions completed under it.

Entire agreement. These Terms, together with the Privacy Policy, the Health & Environmental Disclaimer, and any applicable Guest Terms or Host Agreement, constitute the entire agreement between you and Purestay regarding the platform.

Severability. If any provision is held unenforceable, the remaining provisions remain in effect.

No waiver. Our failure to enforce any provision is not a waiver of it.

Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.

Force majeure. Neither party is liable for failure to perform due to causes beyond its reasonable control.
